Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Fourth Hand ("Fourth Hand," "we," "us," or "our") governing your access to and use of the Fourth Hand mobile application (the "App") and all related services (collectively, the "Service").

By downloading, installing, or using the App, creating an account, or accessing any features of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. BY CREATING AN ACCOUNT OR USING THE SERVICE IN ANY WAY, YOU EXPRESSLY AGREE THAT FOURTH HAND BEARS NO LIABILITY WHATSOEVER FOR ANY INJURY, ACCIDENT, MEDICAL EXPENSE, PROPERTY DAMAGE, OR BICYCLE DAMAGE ARISING FROM ANY REPAIR YOU CHOOSE TO PERFORM. YOU ACCEPT FULL AND SOLE RESPONSIBILITY FOR ALL REPAIRS YOU UNDERTAKE USING OR BASED ON THE SERVICE. If you do not agree to these Terms in full, do not download, install, or use the App.

If you are accepting these Terms on behalf of an organization or company, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Fourth Hand is an iOS mobile application that provides cyclists with AI-powered guidance for bicycle maintenance and repair. The Service is intended to help users understand bike issues, identify potential causes of problems, and learn how to approach common repairs, with the goal of empowering cyclists to handle routine maintenance without always needing a professional shop visit.

Core features of the Service include:

AI Repair Assistant: An AI-powered chat interface where users can ask questions about bicycle maintenance and receive guidance on diagnosing and addressing common bike issues.

Photo Analysis: Users may upload photos of their bicycle or specific components so the AI can provide more targeted guidance based on visual information.

Maintenance Guidance: Step-by-step repair and maintenance information generated by AI based on user questions and uploaded images.

Account & History: Secure account creation via email or Apple Sign-In, with the ability to revisit past conversations and questions.

The Service is available exclusively for iOS devices through Apple's App Store. AI-powered features require an active internet connection.

Usage of the Service is subject to monthly limits based on your subscription tier (see Section 4). These limits exist because providing AI-powered assistance involves real server and API costs. We appreciate your understanding.

3. Eligibility & Accounts

3.1 Age Requirements

You must be at least 13 years old to use Fourth Hand. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3.2 Account Registration

To use Fourth Hand, you must create an account using a valid email address and password, or through Apple Sign-In. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

Use a strong, unique password for your Fourth Hand account (if using email/password login)

Not share your account credentials with any other person

Notify us immediately at [email protected] if you suspect unauthorized access to your account

We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

3.4 One Account Per Person

Each individual may maintain only one Fourth Hand account. Creating multiple accounts to circumvent subscription requirements, usage limits, or account restrictions is a violation of these Terms and may result in the termination of all associated accounts.

4. Subscriptions, Usage Tiers & Billing

4.1 Service Tiers

Fourth Hand offers two service tiers:

Free Tier (no cost): Includes access to the AI repair assistant with a limit of 20 chat messages and 5 image uploads per calendar month. No payment is required for the Free Tier.

Pro Tier (paid subscription): Includes access to the AI repair assistant with a limit of 300 chat messages and 60 image uploads per calendar month. Requires an active paid subscription.

Neither tier currently offers unlimited usage. These limits are in place because AI-powered features involve per-request server and API costs. We are transparent about this and appreciate your understanding. Limits are reset at the start of each calendar month.

4.2 Subscription Plans

Access to the Pro Tier requires one of the following paid plans:

Monthly Plan: $4.99 USD per month, billed every 30 days.

Annual Plan: $49.99 USD per year, billed every 365 days (equivalent to approximately $4.17/month, a savings of approximately 17% versus the monthly plan).

Prices are displayed in USD and may vary by region. All billing is handled by Apple through the App Store's in-app purchase system. Prices are subject to change (see Section 4.6).

4.3 Automatic Renewal

Pro Tier subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. Renewal charges are applied to your Apple ID payment method within 24 hours before the end of the current billing period. By subscribing, you authorize Apple to charge your payment method automatically upon renewal.

4.4 Cancellation

You may cancel your subscription at any time by following these steps:

Open your iPhone Settings app

Tap your name at the top, then tap Subscriptions

Find Fourth Hand, then tap Cancel Subscription

Cancellation must be made at least 24 hours before the end of the current billing period to avoid being charged for the next period. After cancellation, your Pro Tier access continues through the end of the paid billing period. Fourth Hand does not issue refunds for unused portions of a subscription period. For refund requests, contact Apple directly at reportaproblem.apple.com.

4.5 Payment Processing

All payments for the Pro Tier are processed by Apple through the App Store's in-app purchase system. Fourth Hand does not collect, store, or have access to your credit card or payment account information. Your payment method is governed by Apple's terms and policies.

4.6 Price Changes

We reserve the right to change subscription prices at any time. Apple will notify you of any upcoming price changes before they take effect. Your continued subscription after a price change takes effect constitutes your acceptance of the new price. If you do not agree to a price change, you must cancel your subscription before the change takes effect.

4.7 Failed Payments

If a renewal payment fails, Apple will make additional attempts to process it. If payment remains unsuccessful, your subscription will lapse and your account will revert to the Free Tier until a successful payment is made and your Pro Tier subscription is reinstated.

4.8 Usage Limit Overages

Once you have reached your monthly message or image limit for your current tier, additional AI assistance will not be available until the following calendar month's reset, or until you upgrade to the Pro Tier. Fourth Hand will provide notice within the App when you are approaching your limit.

5. AI Features — Important Disclaimer

Please read this section carefully before relying on any guidance provided by Fourth Hand.

5.1 Nature of the Service

Fourth Hand is a consumer guidance and educational tool, not a certified bicycle mechanic, licensed repair service, or professional technical authority. The AI-powered guidance provided through Fourth Hand is intended to help you understand potential causes of bike issues and point you in a useful direction. It is:

General educational information, not professional mechanical advice

Based on AI inference from your text descriptions and photos, not a physical inspection of your bicycle

Designed to supplement, not replace, your own judgment and the assessment of a qualified bicycle mechanic

5.2 Accuracy Limitations

AI-generated guidance may be inaccurate, incomplete, or unsuitable for your specific bicycle, component, or situation. Factors that can affect the quality of guidance include:

The quality, angle, and clarity of photos you upload

Proprietary, custom, or uncommon components not well-represented in AI training data

Underlying issues that are not visible in photos or described in your questions

Differences between bicycle models, component versions, and regional or manufacturing variants

The inherently probabilistic nature of AI systems

5.3 Safety-Critical Components

Certain bicycle components are safety-critical. Improper maintenance or repair of brakes, wheels, forks, headsets, handlebars, suspension systems, and other structural components can result in serious injury or death. Before performing any repair on a safety-critical component:

Consult a qualified bicycle mechanic if you are uncertain about any step

Verify any guidance against the manufacturer's service documentation for your specific component and model

Test your repair thoroughly in a controlled environment before riding

Do not ride a bicycle you believe may be unsafe, regardless of what any AI system or app suggests

5.4 Your Responsibility

By using Fourth Hand, you acknowledge and agree that:

You use AI-generated guidance entirely at your own risk

You are solely responsible for determining whether a repair is appropriate for your skill level, tools, and situation

Fourth Hand does not guarantee the accuracy, completeness, or suitability of any guidance provided

Fourth Hand is not liable for any injury, property damage, or loss arising from your reliance on the Service (see Section 12)

5.5 When to See a Professional

Fourth Hand exists to help you save money and learn about your bike. However, some situations require in-person professional attention. If you are unsure about a repair, if a component appears structurally compromised, or if your safety is at risk, please take your bicycle to a qualified bike shop. No app is a substitute for hands-on professional assessment.

6. Acceptable Use

You agree to use Fourth Hand only for lawful purposes and in accordance with these Terms.

6.1 Prohibited Activities

You agree NOT to:

Use the App for any unlawful purpose or in violation of any applicable law or regulation

Attempt to access, tamper with, or interfere with Fourth Hand's systems, servers, or infrastructure

Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App

Upload or transmit malicious code, viruses, or any content that may interfere with the App or its users

Attempt to scrape, harvest, or extract data from the App through automated means

Impersonate any person or entity, or misrepresent your affiliation with any person or entity

Create multiple accounts to circumvent subscription requirements, monthly usage limits, or account restrictions

Share, resell, or sublicense your account or subscription to any other person

Use the App for commercial bicycle repair services without our express written permission

Use the AI chat features to request content unrelated to bicycle maintenance or repair

Attempt to circumvent, "jailbreak," or manipulate the behavior of the AI systems underlying the Service

6.2 Content Restrictions

You agree not to submit or transmit content through the App that:

Is defamatory, abusive, threatening, or harassing toward any person

Violates the intellectual property rights of any person or entity

Includes personal information of third parties without their consent

You know to be false or misleading

6.3 Enforcement

We reserve the right to investigate suspected violations of these Terms and, in our sole discretion, to suspend or terminate your account and/or report violations to appropriate authorities. Repeated or egregious abuse of the AI features will result in account suspension.

7. User Content

7.1 Your Content

"User Content" means any information, data, photos, text, or other content you submit, upload, or transmit through the App, including bicycle photos, chat messages, and maintenance questions.

7.2 Ownership

You retain all ownership rights to your User Content. Fourth Hand does not claim ownership of any photos, messages, or other content you create or upload.

7.3 License Grant to Fourth Hand

By submitting User Content, you grant Fourth Hand a limited, non-exclusive, royalty-free, worldwide license to:

Store, process, and transmit your User Content as necessary to provide the Service (including transmitting photos and messages to OpenAI for AI processing)

Display your User Content back to you within the App

Create aggregated, anonymized statistical data derived from usage patterns to improve the Service (no individual User Content is identifiable in such aggregated data)

This license does not grant Fourth Hand the right to sell your User Content, use your photos for AI model training beyond what is described in OpenAI's terms (see Section 9.1), or share your User Content with third parties except as described in these Terms or our Privacy Policy.

7.4 Your Representations

By submitting User Content, you represent and warrant that: (a) you own or have the right to submit such content; (b) your User Content does not infringe any third party's intellectual property, privacy, or other rights; and (c) your User Content does not violate any applicable law.

7.5 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, to be harmful, illegal, or objectionable. You may delete your own chat history and uploaded photos at any time within the App.

8. Privacy & Data

Your privacy matters to us. Our Privacy Policy, which is incorporated into these Terms by reference, describes in detail how we collect, use, store, and protect your personal information. By using Fourth Hand, you agree to our Privacy Policy.

8.1 Data We Collect

In connection with providing the Service, we collect information including your email address (if using email registration), Apple ID information (if using Apple Sign-In), the content of your chat messages and uploaded photos (processed via OpenAI), and usage data such as message and image counts.

8.2 Firebase (Google)

Your account information and usage data are stored using Firebase, a backend infrastructure platform provided by Google. By using Fourth Hand, you acknowledge that your data is stored and processed on Firebase's infrastructure, subject to Google's applicable terms and privacy policies.

8.3 Data Retention & Deletion

Upon deletion of your account, your personal data and conversation history will be deleted from our systems within 30 days, subject to any legal retention obligations. You may request deletion of your account at any time through the App settings or by contacting [email protected].

9. Third-Party Services

Fourth Hand depends on and integrates with third-party services to deliver the AI-powered features of the App.

9.1 OpenAI

The AI repair assistant, including photo analysis and chat responses, is powered by OpenAI's API (including GPT-4 and GPT-4 Vision). When you send messages or upload photos, that content is transmitted to OpenAI for processing. Your use of these features is subject to OpenAI's usage policies. OpenAI may retain and process data submitted through their API in accordance with their own terms and privacy policy. We encourage you to review OpenAI's privacy policy at openai.com/privacy before using AI-powered features.

9.2 Firebase (Google)

Account management, data storage, and authentication (including Apple Sign-In verification) are handled using Firebase. Firebase's terms of service apply to data stored through their platform.

9.3 Apple

The App is distributed exclusively through Apple's App Store. All in-app purchases and subscription billing are processed by Apple. Apple's App Store terms and payment policies govern all transactions. See also Section 16 regarding Apple-specific terms.

9.4 No Endorsement

References to third-party services in these Terms do not constitute an endorsement of those services. We are not responsible for the practices, content, security, or availability of third-party platforms. You access third-party services at your own risk.

10. Intellectual Property

10.1 Fourth Hand's Intellectual Property

The App, including its design, code, interface, features, branding, and all content (excluding User Content), is owned by or licensed to Fourth Hand and is protected by copyright, trademark, and other intellectual property laws. The Fourth Hand name and logo are trademarks of Fourth Hand.

10.2 License to Use the App

Subject to these Terms and (where applicable) payment of subscription fees, Fourth Hand grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on iOS devices that you own or control, solely for your personal, non-commercial use.

10.3 Restrictions

Except as expressly permitted by these Terms, you may not copy, modify, or create derivative works of the App; reverse engineer or disassemble the App; distribute, sell, or sublicense the App; remove any proprietary notices or labels; or use the App in any manner not expressly authorized.

10.4 Feedback

If you provide suggestions, feature ideas, or feedback about Fourth Hand ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use and incorporate such Feedback without any obligation, compensation, or restriction to you.

11. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, Fourth Hand does not warrant that:

The Service will be uninterrupted, error-free, or free of security vulnerabilities

Any AI-generated guidance is accurate, complete, reliable, or suitable for your specific bicycle or situation

The results obtained from using the Service will meet your expectations or needs

Any defects or errors in the Service will be corrected

The Service is free from viruses or other harmful components

AI-generated repair guidance will not result in damage to your bicycle, property, or injury to yourself or others

Fourth Hand is a consumer educational tool and does not constitute professional mechanical advice. Always verify repair guidance against manufacturer specifications and consult a qualified bicycle mechanic for safety-critical repairs or when in doubt.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

12.1 Exclusion of Consequential Damages

IN NO EVENT WILL FOURTH HAND, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF DATA, PERSONAL INJURY, PROPERTY DAMAGE (INCLUDING TO YOUR BICYCLE), OR ANY OTHER LOSS ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR RELIANCE ON AI-GENERATED GUIDANCE, EVEN IF FOURTH HAND HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12.2 Cap on Liability

IN NO EVENT WILL FOURTH HAND'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO FOURTH HAND IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) TWENTY-FIVE DOLLARS ($25.00 USD).

12.3 Jurisdiction Limitations

In jurisdictions where liability limitations cannot be fully enforced, Fourth Hand’s liability shall be limited to the maximum extent permitted by applicable law. Under no circumstances, in any jurisdiction, does Fourth Hand assume any liability for personal injury, medical expenses, property damage, or bicycle damage arising from repairs performed by the user. The user assumes sole and complete responsibility for any repair they choose to undertake. Fourth Hand is an informational tool only. The decision to perform any repair, and the execution of that repair, rests entirely with the user. Fourth Hand has no physical presence in, knowledge of, or control over any repair performed by any user at any time.

12.4 Express Assumption of Risk

BY CREATING AN ACCOUNT OR USING THE SERVICE IN ANY WAY, YOU EXPRESSLY ACKNOWLEDGE, UNDERSTAND, AND IRREVOCABLY AGREE THAT:

You are performing any and all bicycle repairs yourself, as an independent individual acting entirely on your own judgment and at your own risk;

Fourth Hand provides informational guidance only and is not a mechanic, repair service, licensed technician, or professional technical authority of any kind;

Fourth Hand has no control over how repairs are performed, what tools are used, whether guidance is applied correctly, or the condition of your bicycle or components;

Any injury, accident, medical expense, or property damage resulting from a repair you perform is solely and entirely your responsibility, regardless of whether the repair was based on guidance from the Service;

Fourth Hand shall not contribute to, cover, reimburse, or bear any portion of any medical expenses, repair costs, legal fees, or damages of any kind arising from your use of the Service or any repair you perform;

Fault for any failed or improper repair lies with the individual performing the repair, not with Fourth Hand as an informational tool; and

You have voluntarily and knowingly assumed all risks associated with performing bicycle repairs based on AI-generated guidance, and you irrevocably release Fourth Hand from all liability related thereto.

THIS ASSUMPTION OF RISK AND RELEASE OF LIABILITY IS A MATERIAL CONDITION OF YOUR USE OF THE SERVICE. IF YOU DO NOT ACCEPT THESE TERMS IN FULL, YOU MUST IMMEDIATELY CEASE USE OF THE APP AND DELETE YOUR ACCOUNT.

13. Indemnification

You agree to defend, indemnify, and hold harmless Fourth Hand and its owners, officers, employees, agents, and licensors from and against any claims, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

Your use of or reliance on the Service, including any AI-generated guidance

Your User Content

Your violation of these Terms

Your violation of any third party's rights, including intellectual property or privacy rights

Any injury, accident, or property damage (including to your bicycle) arising from repairs you undertake using or based on the Service

Fourth Hand reserves the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense, and you agree to cooperate with our defense of such claims.

14. Service Modifications & Availability

14.1 Modifications

We reserve the right to modify, update, suspend, or discontinue any part of the Service at any time, with or without notice. This includes the ability to adjust usage limits, features, and pricing. We will provide reasonable advance notice of material changes where practicable.

14.2 Usage Limit Changes

The monthly message and image limits for both the Free and Pro Tiers are subject to change. If we reduce the limits for an existing subscription plan, we will provide at least 30 days' advance notice. If we reduce the Free Tier limits, we will notify users within the App.

14.3 Service Availability

We do not guarantee that the Service will be available at all times or without interruption. The Service may be unavailable due to maintenance, technical issues, or circumstances beyond our control, including outages affecting OpenAI's API or Firebase infrastructure. We are not liable for any unavailability of the Service.

14.4 AI Service Dependencies

AI-powered features depend on OpenAI's API. Interruptions or limitations in OpenAI's service will affect Fourth Hand's core features. We are not responsible for third-party service outages.

14.5 Discontinuation

If we decide to permanently discontinue the Service, we will provide at least 30 days' advance notice where possible. If the Service is discontinued during an active paid subscription period, we will work to arrange a prorated refund through Apple for the unused portion of the subscription.

15. Termination

15.1 Termination by You

You may terminate your account at any time through the App settings or by contacting [email protected]. Deleting your account does not automatically cancel an active subscription. You must cancel your subscription separately through your iOS Settings to avoid future charges.

15.2 Termination by Fourth Hand

We may suspend or terminate your account and access to the Service immediately, without prior notice, if we determine that you have violated these Terms, engaged in fraudulent activity, abused the AI features, or if continued provision of the Service poses a legal or security risk to us or to other users.

15.3 Effect of Termination

Upon termination of your account:

Your access to the Service (including Free Tier features) will cease

Any active Pro Tier access will continue through the end of the paid billing period if you cancelled through normal channels; otherwise access ceases immediately

Your User Content and personal data will be deleted within 30 days in accordance with our Privacy Policy

Sections 5, 6, 7.2, 7.3, 10, 11, 12, 13, and 17 of these Terms will survive termination

16. Governing Law & Dispute Resolution

16.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of North Carolina and the United States of America, without regard to conflict of law principles. For users in the European Union or United Kingdom, mandatory consumer protection laws of your country of residence may also apply.

16.2 Informal Resolution

Before filing any formal claim, you agree to contact Fourth Hand at [email protected] and attempt to resolve the dispute informally. We will make good-faith efforts to resolve the dispute within 30 days of receiving written notice.

16.3 Binding Arbitration (U.S. Users)

If informal resolution is unsuccessful, you and Fourth Hand agree that any dispute arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration, not in court, except for claims qualifying for small claims court. Arbitration will be conducted by a recognized arbitration provider under their applicable commercial arbitration rules.

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY AND NOT AS A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

16.4 Exception for Injunctive Relief

Either party may seek injunctive or other equitable relief in a court of competent jurisdiction for matters involving intellectual property infringement, breach of confidentiality obligations, or other circumstances where monetary damages would be an inadequate remedy.

16.5 EU/UK Consumer Rights

Nothing in these Terms limits your statutory rights as a consumer under EU or UK consumer protection law, including your right to bring a claim before your national courts.

17. Apple App Store Additional Terms

Fourth Hand is distributed exclusively through Apple's App Store. The following additional terms apply:

Acknowledgment: These Terms are between you and Fourth Hand only, not with Apple. Apple is not responsible for the App or its content.

Scope of License: The license granted under these Terms is limited to use on Apple-branded devices running iOS, as permitted by the App Store Terms of Service.

Maintenance & Support: Fourth Hand is solely responsible for providing maintenance and support for the App. Apple has no obligation to provide any maintenance or support.

Warranty: To the extent any warranty applies and cannot be disclaimed, Apple will have no warranty obligation. Any warranty claim should be directed to Fourth Hand, not Apple.

Product Claims: Fourth Hand, not Apple, is responsible for addressing any claims relating to the App, including product liability, consumer protection, or intellectual property infringement claims.

Legal Compliance: You represent that you are not located in a country subject to a U.S. government embargo, and that you are not on any U.S. government prohibited or restricted parties list.

Third-Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and have the right to enforce these Terms against you as a third-party beneficiary.

18. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this document and notify you via push notification or in-app notice. We will provide at least 30 days' notice before material changes take effect where practicable.

Your continued use of the App after updated Terms take effect constitutes your acceptance of the changes. If you do not agree to updated Terms, you should cancel your subscription and delete your account before the changes take effect.

For changes required by law or in response to an emergency, we may not be able to provide advance notice.

19. Miscellaneous

19.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Fourth Hand with respect to the Service and supersede all prior agreements and understandings.

19.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

19.3 Waiver

Fourth Hand's failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

19.4 Assignment
